In Effect: Dosing and Supply Limits for Medical Marijuana

In compliance with Florida law, the Florida Department of Health, Office of Medical Marijuana Use (OMMU) released an emergency rule, effective Aug. 26, quantifying a daily dose amount with equivalent dose amounts for each allowable form of marijuana dispensed by a medical marijuana treatment center. The state’s controlling medical marijuana statute, Section 381.986, F.S., authorizes the OMMU to adopt emergency rules without having to state specific facts and reasons for finding an immediate danger to the public health, safety, or welfare and its reasons for concluding that the procedure used is fair under the circumstances, as typically required in the emergency rulemaking process.

Emergency Rule 64ER22-8 provides the following daily and 70-day limitations for each allowable form of marijuana dispensed by a medical marijuana treatment center:

The emergency rule also provides a pathway for qualified physicians to request an exception to the daily dose amount limit, the 35-day supply limit of marijuana in a form for smoking, and the 4-ounce possession limit of marijuana in a form for smoking. The OMMU has updated its instructional guides to account for these changes and has included a new guide for submitting a “Request for Exception” form.
